Turs Terms of Service

Contract governing access to and use of the Turs Platform, the contracting of Tours between Travelers and Hosts, and the rights and obligations of the parties.

These Terms of Service (the "Terms") are a legally binding contract entered into between Turs Technologies LLC, a limited liability company (LLC) formed under the laws of the State of Delaware, United States of America, with operations in the Republic of El Salvador, Central America (referred to interchangeably as "Turs", "we", "us" or "the Company"), and every person who accesses, registers on, browses, consults, books through, publishes on or in any way uses the Platform, its websites, its mobile application or its messaging channels (the "User" or "you").

By creating an Account, ticking the acceptance checkbox during the booking process, completing a Booking — including as a Guest through the messaging channels —, publishing a Tour as a Host, making a payment or otherwise using the Platform, you expressly, knowingly and unequivocally declare that you have read these Terms in full, that you understand their content and legal consequences, that you have sufficient legal capacity to be bound by them, and that you accept them in full, together with the Privacy Policy, the Cancellation Policy, the particular conditions displayed to you for each Booking and any policies, operating rules, notices or instructions that Turs publishes or communicates through the Platform, all of which form an integral and inseparable part of these Terms by express reference. If you use the Platform on behalf of a company or other legal entity, you represent that you have sufficient authority to bind it to these Terms.

If you do not agree with any provision of this document, you must refrain from using the Platform and, where applicable, request the deletion of your Account under the procedure set out in Section 26. Continued use of the Platform after a modification is published constitutes acceptance of the version then in force, as provided in Section 28.

1. Purpose, scope and order of precedence of documents

1.1. Purpose. The purpose of these Terms is to govern the conditions of access to and use of the Platform, as well as the contractual framework under which the Hosts who publish Tours and the Travelers who book them enter into, directly and under their sole responsibility, the corresponding contracts for the provision of tourism services.

1.2. Scope. These Terms apply to all channels, interfaces and features that Turs makes available to Users, including the turslatam.com website and its subdomains (among them portal.turslatam.com), the Turs mobile application, the AI Assistant, and the support and messaging channels operated by Turs (including WhatsApp, Instagram and Facebook Messenger).

1.3. Order of precedence. In the event of any conflict between these Terms and any other contractual document, the following shall prevail, in this order of precedence: (i) the particular conditions expressly accepted by the User for a specific Booking, as reflected in the price breakdown shown before payment and in the Booking confirmation; (ii) the Cancellation Policy, published at turslatam.com/cancellation; (iii) the Privacy Policy, published at turslatam.com/privacy, with respect to the processing of personal data; and (iv) these Terms. Each higher-ranking document prevails only within its specific subject matter.

1.4. Entire agreement. These Terms, together with the documents they refer to, constitute the entire agreement between the parties with respect to their subject matter and supersede any prior agreement, understanding, communication, commercial offer, advertising material or statement, whether oral or written, relating to the same subject matter. No provision of a lower-ranking document may be construed as extending Turs's obligations beyond what is expressly assumed in this instrument, or as creating for Turs guarantees or commitments of result that are not expressly stated.

1.5. Language. The Spanish-language version of this document is the master version. This English text is provided as a convenience translation; if translations exist and there is any discrepancy, the Spanish version prevails, unless applicable law provides otherwise.

2. Definitions and interpretation

For the purposes of these Terms, the following terms, when capitalized, shall have the meanings given to them below, whether used in the singular or the plural:

  • Platform: the set of systems, interfaces, applications and technology services operated by Turs, including the turslatam.com website and its subdomains, the Turs mobile application, and the support and messaging channels operated by Turs (including WhatsApp, Instagram and Facebook Messenger).
  • User: any person who creates an Account or uses the Platform in any capacity, whether or not they ultimately complete a Booking.
  • Traveler (or Tourist): the User who uses the Platform to search for, book or take part in a Tour.
  • Guest: a person who uses the Platform or makes a Booking without having completed the registration of an Account, for example through the messaging channels. Guest accounts have limited functionality until registration is completed.
  • Host: a natural or legal person, independent from Turs, who lists and provides Tours through the Platform. Hosts may rely on authorized co-hosts to help manage their Tours.
  • Tour: an experience, activity or tourism service listed by a Host on the Platform and provided in person by the Host.
  • Listing: the publication through which the Host describes a Tour, its price, duration, meeting point, capacity, requirements and other particular conditions.
  • Booking: a request for, or contracting of, a Tour made by a Traveler through the Platform, in either of the modes described in Section 7.
  • Account: the personal, non-transferable, credential-protected registration through which the User accesses the features of the Platform.
  • Service: the technology intermediation service described in Section 3.
  • Base price: the price of the Tour set by the Host (per person or per group), before the Traveler service fee.
  • AI Assistant: Turs's automated assistant based on artificial intelligence, available to Travelers and Hosts on the channels described in Section 17. On the Platform it is presented under the commercial name "Súper Agente" (and in some materials as "Concierge"); any reference to either of those names is understood as a reference to the AI Assistant.
  • Cancellation Policy: the document governing Booking cancellations and refunds, published at turslatam.com/cancellation, whose essential rules are summarized in Section 13.
  • User Content: any text, photograph, review, description, message or material that the User uploads, publishes or transmits through the Platform.

2.1. Rules of interpretation

  • Section headings are for organizational convenience only and do not affect the interpretation of the sections or limit their scope.
  • The expressions "includes", "including", "for example" and equivalents shall always be understood as illustrative and not limiting.
  • Any reference to a period expressed in days or hours refers to calendar days and consecutive hours, unless expressly stated otherwise.
  • Any reference to a time of day is made in the official time zone of the Republic of El Salvador (America/El_Salvador), unless expressly stated otherwise.
  • Any reference to monetary amounts is made in United States dollars (USD).

3. Legal nature of the Service and Turs's contractual position

3.1. Turs is a technology intermediary. Turs operates a marketplace-type technology platform that connects Travelers with independent Hosts. Tours are organized and provided by the Hosts, not by Turs. Turs is not an organizer of the Tours, nor a tour operator, travel agency, transportation company, insurer or insurance intermediary, nor an employer of the Hosts, and does not provide the tourism services advertised. In particular, Turs does not design or carry out the itineraries, does not set the Base price — which each Host sets freely —, does not transport Travelers, does not take custody of their belongings, and does not issue, underwrite or market insurance policies of any kind.

3.2. The Tour contract is entered into between Traveler and Host. The contract for the provision of the Tour is formed directly and exclusively between the Traveler and the Host, who assume the rights and obligations arising from that relationship. Turs is not a party to that contract, does not guarantee its performance and assumes no obligation of result whatsoever regarding the performance, quality, safety, legality or suitability of the Tour. Turs's involvement in channeling the payment, in the communication between the parties or in handling incidents does not alter this position and does not make Turs a party to the Tour contract.

3.3. No employment, corporate or agency relationship. Nothing in these Terms shall be construed as creating between Turs and any User an employment, dependency, mandate, agency, partnership, franchise or joint-venture relationship. Hosts act on their own account and at their own risk, as provided in Section 6.8.

3.4. Functions Turs does perform. The functions Turs undertakes are limited to making the technology infrastructure available; facilitating the publication of Listings and the management of Bookings; channeling payments through payment service providers; making available communication tools, the AI Assistant and the support channels; and applying the review and verification procedures described in these Terms, all in exchange for the fees and commissions provided for herein. These functions are obligations of means and in no case obligations of result. Consequently, Turs does not guarantee Hosts any particular volume of visits, requests or Bookings, nor does it guarantee Travelers the availability of any specific Tour, and the diligent performance of these functions exhausts the scope of the obligations assumed by Turs.

3.5. No control and no permanent supervision. Turs does not exercise control over the conduct of Users, nor over the ultimate accuracy of the information they provide, nor over the actual performance of the Tours. Turs reviews Listings before publishing them and may verify the identity of Hosts in accordance with Section 5, but such review and verification are reasonable risk-reduction measures and do not amount to a guarantee, certification, homologation, expert appraisal or endorsement of the quality, safety, legality or suitability of the Tours, which are the responsibility of the Host who provides them. These measures are likewise provided as obligations of means: their existence does not create for Turs a general duty of supervision or an obligation to detect every infringement, and any insufficiency of such measures in a specific case does not, in itself, constitute a breach by Turs.

4. Eligibility, legal capacity and Account registration

4.1. General requirements

  • You must be at least 18 years old to create an Account, make a Booking or publish a Tour. By accepting these Terms you represent that you meet this requirement. Minors may only take part in a Tour accompanied by, and under the responsibility of, an adult who made the Booking.
  • You agree to provide truthful, accurate, complete and up-to-date information (including your name, email and contact phone number) and to keep it current throughout the relationship.
  • Creating accounts under a false identity, impersonating others, or operating accounts on behalf of another person without authorization is not permitted.
  • You are responsible for the confidentiality of your credentials and for all activity carried out from your Account. You must safeguard them with due diligence and notify us without delay of any unauthorized use or suspected compromise of your Account.

Turs may verify compliance with these requirements at any time and by any lawful means, and may restrict, suspend or cancel the access of anyone who fails to demonstrate compliance or subsequently ceases to comply.

4.2. Registration and sign-in methods

You can create an Account and sign in using: (a) email address and password; (b) your Google account; or (c) your Apple account. Additionally, the AI Assistant can help you create an Account from the conversation by verifying your email with a one-time code (OTP). Registration through federated authentication providers is additionally governed by the terms of those providers.

4.3. Guests and messaging channels

If you book through the messaging channels (for example, WhatsApp) without a registered Account, a Guest profile linked to your contact channel will be created to manage your Booking. You can later link that channel to a full Account. Guest Bookings are governed by these same Terms.

4.4. Truthfulness and consequences of inaccuracy

Providing false, incomplete, outdated or misleading information, impersonating identities, using another person's or altered documentation, and concealing relevant circumstances constitute material breaches that entitle Turs to suspend or cancel the Account immediately, void the associated Bookings, withhold as a precaution the amounts linked to transactions suspected of fraud while they are being investigated, and take any applicable legal action. The User is liable for the damages that their lack of truthfulness or diligence causes to Turs, to other Users or to third parties.

5. Host verification and onboarding

5.1. Application and approval. To publish Tours you must apply through the Platform's application form and be approved by the Turs team. Host status is personal and non-transferable. Turs may reject applications or revoke Host status in accordance with these Terms.

5.2. Identity verification. Turs may request identity documents from the Host to verify who they are. The documentation provided is stored in a protected manner in accordance with the Privacy Policy and is used exclusively for the verification, security and compliance purposes described in it.

5.3. Bank verification. To receive payments, the Host must register a bank account in El Salvador and pass Turs's bank verification, in accordance with Section 16.

5.4. Scope of verification. The verification procedure described in this Section applies only to Hosts, as a condition for publishing Tours and receiving payouts.

5.5. Non-exhaustive nature. Verification is intended to reduce risk and does not constitute a certification of solvency, good standing, professional competence or absence of a criminal record, nor a guarantee of the future conduct of the verified Host. "Verified" status does not make Turs responsible for the Tours or for the Host's conduct, and may not be construed as an endorsement, recommendation or backing of the activity the Host carries out.

6. Publication of Tours and Host obligations

6.1. Truthfulness of Listings. Listings must be truthful, complete and not misleading: the description, price, duration, meeting point, capacity, requirements and photographs must correspond to the experience actually offered. Photographs must be real, current and correspond to the Tour actually offered, without manipulations that alter its nature, conditions or scope. The Host is solely responsible for the content, accuracy, currency and lawfulness of their Listings, and must keep them up to date for as long as they remain published.

6.2. Prior review. New Tours and content edits go through Turs review before being published. Turs may reject, pause or remove Listings that breach these Terms; approval of a Listing does not constitute any guarantee, as provided in Section 3.5.

6.3. Provision as advertised. The Host undertakes to provide the Tour on the date, under the conditions and with the characteristics advertised, with due diligence and in compliance with the regulations applicable to their activity (permits, licenses, tax obligations, safety rules). The Host represents that they have the capacity and, where required by law, the authorizations necessary to operate the tourism activity they offer. The Host also undertakes to respond diligently and within a reasonable time to communications from Travelers and from Turs relating to their Tours, and to refrain from requesting or accepting payments, guarantees or compensation outside the mechanisms enabled on the Platform, in accordance with Sections 8.6 and 12.

6.4. Managing requests. The Host must respond to Booking requests within 48 hours of receiving them; after that period, they expire automatically in accordance with Section 7.2.

6.5. Host cancellations. If the Host cancels or declines a Booking, the Traveler always receives a full refund of anything charged; if the Host cancels less than 24 hours before the Tour, the penalty described in Section 13.4 also applies, which can be appealed by opening a case. Repeated or unjustified cancellations may lead to suspension of the Account; to assess them, Turs takes into account how often they occur, the notice with which each cancellation takes place, and the circumstances evidenced by the Host.

6.6. Tax obligations. The Host is solely responsible for determining and complying with their tax and social security obligations arising from the provision of their Tours, as well as their formal and invoicing obligations.

6.7. Co-hosts. The Host may authorize co-hosts with limited or full permissions to manage their Tours. The primary Host is responsible for the acts of their co-hosts on the Platform.

6.8. Independent relationship. Nothing in these Terms creates an employment, agency, partnership or franchise relationship between Turs and the Host. The Host acts on their own account and assumes their own business risks.

7. Booking request, acceptance and formation

7.1. Booking modes. There are two modes, depending on how each Tour is configured:

  • Instant booking: when you complete the request, a payment order with a secure payment link is generated immediately. The Booking is confirmed when the payment is processed successfully.
  • Booking with Host approval (request-to-book): your request is first sent to the Host, who may accept or decline it. You are not charged anything when you submit the request. If the Host approves it, you will receive a secure payment link to complete the Booking; your spot is secured at the moment of approval.

7.2. Expiration of requests. If the Host does not respond to a request within 48 hours, it expires automatically at no charge to the Traveler and with no liability for Turs. The expiration of a request does not prevent the Traveler from submitting a new request for the same or another Tour.

7.3. Expiration of payment orders. Pending payment orders expire after 24 hours, counted from the creation of the instant Booking or from the approval of the request, as applicable. If you do not complete the payment within that period, the Booking is marked as expired and the spot is released, with no charge or penalty of any kind for the Traveler.

7.4. Payments on cancelled or expired Bookings. If a payment were to be processed after the Booking has already been cancelled or has expired, it will be automatically refunded in full.

7.5. Spots and capacity. Each Tour has a maximum capacity defined by the Host. The Platform validates spot availability at the moment the Booking is created (instant mode) or at the moment of approval (approval mode). The availability shown on the Platform is updated dynamically; Turs does not guarantee that a spot you have viewed will remain available until the payment is confirmed, and is not liable for any loss of opportunity resulting from a spot being taken in the meantime.

7.6. Formation. The Booking is deemed formed and confirmed when the payment is processed successfully. Formation upon payment governs the confirmation of the contract; cancellation periods, however, are counted from the creation of the Booking in accordance with the Cancellation Policy. The binding conditions of each Booking are, in all cases, those shown in the price breakdown displayed before payment and in the confirmation sent to the Traveler; any information obtained through another channel, including the AI Assistant, is merely indicative, as provided in Section 17.5.

7.7. Receipts and communications. You will receive confirmations and notices about your Bookings by email and, where applicable, through the messaging channel you used and through app notifications.

8. Price, service fee, taxes and payment conditions

8.1. Currency. All prices on the Platform are stated and charged in United States dollars (USD). If your payment method is denominated in another currency, your issuing institution may apply its own exchange rates and fees, over which Turs has no involvement or responsibility. Turs does not carry out currency exchange transactions.

8.2. Composition and breakdown of the price. The total price of each Booking is made up of the Base price freely set by the Host, the Traveler service fee described in Section 8.3 and any other applicable charge, less any validly applied discounts, promotions or coupons. The total price is always shown itemized, in clear and understandable terms, before the payment is confirmed. That breakdown is the only binding one: any estimate, simulation or price information obtained through another channel — including the AI Assistant — is merely indicative and does not bind Turs or the Host. Once the payment is confirmed, the breakdown is incorporated into the Booking confirmation sent to the Traveler, which documents the agreed economic conditions.

8.3. Traveler service fee. A Turs service fee payable by the Traveler is added to the Base price set by the Host; it compensates the provision of the Platform and of the Service described in Section 3 (booking management, payment processing, communication tools and support). Turs's service fee is variable and may differ depending on the booking channel, the type of Tour, the market, the existence of promotions and other operational variables. The exact amount applicable to your Booking is always shown itemized, in clear and understandable terms, before the payment is confirmed, and that itemized amount is the only binding one. Turs reserves the right to modify its fees prospectively in accordance with Section 28, without such modification affecting Bookings already paid. Any reduction of or discount on the service fee in a specific Booking does not create a right to the same treatment in future Bookings.

8.4. Payment processing. Payments are processed entirely within the Platform through duly authorized payment service providers, by credit or debit card and the compatible digital wallets displayed during checkout, with strong customer authentication where required by the issuing institution. Turs does not store your card numbers on its systems: payment data is handled by the payment service provider under its own terms and the security standards of the payment industry, as described in the Privacy Policy.

8.5. You always execute the payment yourself. You always authorize and complete every charge personally at the secure checkout: neither Turs nor the AI Assistant executes charges on your behalf. This rule applies across all channels of the Platform, including Bookings initiated through the AI Assistant or the messaging channels.

8.6. Payments only through the Platform. All Tour-related payments must be made through the Platform. Paying, requesting, accepting or receiving, through any channel outside the Platform, the price of a Tour or any component of it is expressly prohibited. Breach of this prohibition constitutes a material breach, deprives the infringing User of all coverage, assistance, mediation and protection associated with the Platform — including the refund, support and incident-handling mechanisms — and entitles Turs to suspend or cancel the Account, in accordance with Sections 11, 12 and 21.

8.7. Taxes. Hosts are responsible for determining and complying with their own tax obligations arising from the provision of the Tours. Turs does not provide tax advice: each User must inform themselves of the tax, formal and invoicing obligations that apply to them under the applicable regulations.

9. Shop

9.1. Purpose. Some Tours enabled by Turs offer a shop of physical items (merchandise and products related to the experience) sold by the Host through the Platform.

9.2. Purchase conditions. Items can only be added to confirmed Bookings for the same Tour, are subject to inventory availability, and their prices are stated in USD. The item's price is fixed at the moment it is added to the Booking. Published products go through Turs review before becoming available.

9.3. Charging and delivery. The charging and delivery conditions for shop items (moment of the charge, payment method, and manner and place of delivery) will be defined and published in an update to these Terms before charging for them is enabled.

9.4. Turs's position. The seller of the items is the corresponding Host; Turs acts as an intermediary under the same terms as Section 3 and does not assume the position of seller, manufacturer, importer or distributor of the items, nor does it guarantee their quality, suitability or conformity, without prejudice to the rights that consumer protection regulations grant the buyer against whoever is responsible.

10. Referral program

10.1. Application. Turs operates a referral program that any User can apply to from the Platform. Participation requires approval by the Turs team; applying does not, in itself, confer any right to participate in the program.

10.2. Benefits. Each approved referrer is assigned a coupon. Both the discount obtained by the Traveler who uses the coupon and the commission received by the referrer are variable and are determined in accordance with the commercial criteria in force from time to time: the applicable discount is shown on the Platform when the coupon is applied, before the payment is confirmed, and the referrer's commission is shown in the referrer dashboard. Those values, as shown in each case, are the only binding ones.

10.3. Coupon rules. You cannot use your own coupon, and each Traveler may use a given coupon only once. Coupons are personal, not redeemable for cash, and subject to the particular conditions communicated in each case.

10.4. Crediting and withdrawal. The referrer's commission is credited when the Booking is paid and becomes available once Turs deems the corresponding Tour to have been completed and confirms that there are no open incidents, within the operational timeframes communicated on the Platform. It is withdrawn through a payout request, requires a verified bank account and is subject to the minimum withdrawal amount in force (Section 16.4).

10.5. Modification and fraud. Turs may modify the program's values, or suspend or terminate the referral program, in accordance with Section 28. Fraudulent use of the program (self-referrals, fake accounts, manipulation of Bookings or any similar practice) results in the loss of accumulated commissions, exclusion from the program and, where applicable, the adoption of the measures provided for in Section 21.

11. During the Tour: punctuality, safety and participation

As a Traveler you agree to:

  1. Provide truthful and complete contact information when booking.
  2. Read the Tour description (requirements, meeting point, duration, conditions) before booking, and verify that you and your companions are able to participate.
  3. Arrive on time at the meeting point indicated in the Listing. Failure to show up (no-show) does not give rise to a refund.
  4. Respect the number of people included in your Booking and the maximum capacities of the Tour.
  5. Follow the Host's reasonable safety instructions during the Tour and behave respectfully toward the Host, other participants and third parties.
  6. Assess your own physical fitness for the activity and inform the Host, before booking, of any relevant condition (for example, health or mobility restrictions) that may affect your participation, when the Tour involves physical exertion.
  7. Make all Tour-related payments through the Platform, without arranging payments outside it.
  8. Be responsible for any minors accompanying you, who may only take part accompanied by, and under the responsibility of, an adult who made the Booking.

Material breach of these obligations may result in exclusion from the Tour by the Host without a right to a refund, suspension of the Account, and any liability that may arise toward the Host or third parties. In particular, paying or collecting any amount outside the Platform deprives the infringer of all coverage, assistance, mediation and protection associated with it, in accordance with Section 8.6.

12. User conduct and prohibited uses of the Platform

Any User of the Platform is prohibited from:

  1. Circumventing the Platform: arranging, requesting or accepting payments for Tours outside the Platform, or using the chats to divert transactions and avoid Turs's fees.
  2. Publishing false or misleading information (in Listings, profiles, reviews or Bookings).
  3. Impersonating identities, creating fake accounts or using third parties' accounts without authorization.
  4. Using the Platform for unlawful or fraudulent activities or money laundering.
  5. Harassing, threatening, discriminating against or harming other Users, Hosts or Turs staff.
  6. Reverse engineering, scraping, mass data extraction, unauthorized automated access, or attempting to breach the security of the Platform (including its artificial intelligence systems).
  7. Manipulating reviews, ratings or the referral program.
  8. Using the Platform for purposes other than those intended (for example, sending spam or unauthorized advertising).
  9. Infringing third parties' intellectual property or privacy rights.

Non-compliance may lead to the removal of content, the withholding of payments linked to fraud while it is being investigated, the suspension or termination of the Account (Section 21), and any applicable legal action. Circumvention of the Platform as described in item 1 additionally entails the loss of all coverage, assistance, mediation and protection associated with the Platform, in accordance with Section 8.6, without prejudice to Turs's right to claim the fees and commissions circumvented.

13. Cancellations, refunds and reference to the Cancellation Policy

13.1. Reference. The complete rules on cancellations and refunds are set out in the Cancellation Policy, published at turslatam.com/cancellation, which forms an integral part of these Terms and prevails over them within its subject matter in accordance with the order of precedence in Section 1.3. Its essential rules are summarized below, without prejudice to the full content of that policy; in the event of any discrepancy between this summary and the Cancellation Policy, the latter prevails. The policy is a single, platform-wide policy and applies to all Tours; all time periods are calculated in the El Salvador time zone (America/El_Salvador).

13.2. Cancellation by the Traveler. You are entitled to a full refund only if both of the following conditions are met at the moment you cancel: (a) you cancel within 24 hours of the creation of your Booking (for instant bookings, when you complete it; in the Host-approval mode, when you submit the request — clause 1.3 of the Cancellation Policy), and (b) the Tour starts in 7 days or more, counted from the moment of cancellation. If either of the two conditions is not met, the cancellation does not generate a refund; there are no partial refunds or prorations. The refund covers the total amount actually charged, including the Traveler service fee, and may be subject to transaction costs of the payment gateway, which, where applicable, are deducted from the refunded amount. Only amounts actually charged are refunded: if your payment had not yet been captured, the payment order is simply cancelled. It is not possible to cancel a Booking whose Tour has already started or already took place.

13.3. No date changes. The Platform does not offer the option to "move" or reschedule a Booking. If you need to change the date, you must cancel your Booking (with this policy applying) and create a new Booking for the desired date, subject to availability.

13.4. Cancellation or rejection by the Host. If the Host cancels a Booking or declines a request at any time, the Traveler always receives a full refund of anything they were charged; if nothing had been charged (for example, a request pending approval), there is no amount to refund. If the Host cancels less than 24 hours before the start of the Tour, the Host is additionally subject to a penalty equal to 15% of the Base price of the Booking (the Host's price for the Booking — per-person price multiplied by the number of guests, or the flat group price, as applicable — excluding platform commissions), which is deducted from the withdrawable amount of their payouts (Section 16.3). The Host may appeal the penalty by opening a case with Turs in accordance with Section 14; if the Host does not open a case, the penalty becomes final.

13.5. Refund processing. Refunds are processed through the payment service provider used for the purchase, to the same payment method used. The time it takes for the money to appear depends on your card issuer or wallet, over whose timeframes and processes Turs has no involvement or responsibility. If an automatic refund fails, the case goes to manual review by our team to be completed.

13.6. Cancellations by Turs. Turs may cancel Bookings, refunding the Traveler the amounts actually charged, where there are reasonable indications of fraud, identity theft, a risk to the safety of people or property, a breach of these Terms, or a supervening impossibility of the operation. In these cases, Turs's obligation is discharged with the refund of the amounts actually charged.

13.7. Consumer rights. Nothing in this Section or in the Cancellation Policy limits the non-waivable rights granted to you by the Consumer Protection Law of the Republic of El Salvador and other applicable regulations.

14. Incidents, cases and appeals

14.1. Host cases. The Host may open cases with Turs to appeal penalties or other operational decisions affecting them. Turs will evaluate in good faith the available information — including the documentation provided by the parties and the Platform's records — and communicate its decision. Turs's involvement in these cases is strictly facilitative in nature and does not constitute arbitration, expert determination or institutional mediation.

14.2. Traveler support. The Traveler may raise incidents relating to their Bookings, payments or the conduct of other Users through the help center inside the application, through the AI Assistant (which can open support tickets), or by writing to info@turslatam.com. These same channels are available to report conduct contrary to these Terms or inappropriate content published on the Platform.

14.3. Duty to cooperate. Users agree to cooperate in good faith, provide truthful information and refrain from filing unfounded, reckless or fraudulent claims, the filing of which constitutes a material breach of these Terms.

14.4. Scope of the decision. Turs's decisions on cases and incidents are final at the platform level, without prejudice to the parties' legal rights before the competent authorities and courts.

15. Reviews, ratings and moderation

15.1. Who may review. Only the Traveler holding a Booking whose Tour already took place may leave a review, with one review per Booking. Each review includes a rating from 1 to 5, a comment and up to 4 photographs. The Platform does not currently include reviews of Travelers by Hosts.

15.2. Truthfulness. Reviews must reflect your real experience, be respectful and not contain third parties' personal data, insults, discriminatory content, promotional links or information unrelated to the subject of the review. Fake reviews, paid reviews or reviews written to manipulate the reputation of a Tour or Host are prohibited, as are retaliation through reviews and soliciting reviews in exchange for compensation.

15.3. Host badges. The Platform may display Host categories or badges (currently: New, Verified, Local Expert and Superguide), calculated dynamically from activity and ratings. Badges are informational only and do not constitute a guarantee of quality or an endorsement by Turs.

15.4. Moderation. Turs may review, moderate, refuse to publish or remove reviews and ratings that breach these Terms or the law, without this implying any assumption of editorial responsibility for those published or any general obligation of supervision.

16. Commissions, balance and Host payouts

16.1. Platform commission. As consideration for the Service, Turs receives a service fee payable by the Traveler (Section 8.3) and a platform commission payable by the Host, both variable and determined in accordance with the commercial criteria in force from time to time. The percentage applicable to the Host is communicated to them in their dashboard before the Listing is published and before each Booking is accepted, and the detail of each payout is available in that dashboard. The Host's payout for each Booking is determined by deducting the applicable commission from the Base price actually charged. The values in force may be changed in accordance with Section 28, with no effect on Bookings already paid: the payout for each Booking is governed by the values communicated and applicable at the time of its payment.

16.2. Pending balance and available balance. Funds from a paid Booking are credited to the Host's balance as pending balance. Those amounts are enabled as available balance only once Turs deems the Tour to have been completed and confirms that there are no open incidents, within the operational timeframes communicated in the Host dashboard. While the Tour is pending performance or closure, its amount does not form part of the available balance. Information on pending balances, available balances and movements is reflected in the Host dashboard, which is the reference channel for consultation.

16.3. Withdrawable amount. The withdrawable amount is the available balance minus any outstanding penalties (Section 13.4) and any other amounts owed to Turs that remain outstanding.

16.4. Minimum withdrawal. The Host may request the withdrawal of their available balance provided it reaches the minimum amount in force, currently set at USD 50.00. The minimum in force is shown in the Host dashboard and may be changed in accordance with Section 28.

16.5. Requirements and payment method. To withdraw funds, the Host must register a bank account in El Salvador and pass Turs's bank verification. Bank details are stored encrypted and with restricted access. Once the request is approved, the transfer is issued to the Host's verified bank account within the operational timeframes in force communicated in their dashboard.

16.6. Withdrawal processing. Each withdrawal request undergoes review and is processed and approved by the Turs team; if a withdrawal is rejected, the balance is returned to the Host's wallet.

16.7. Bank details. The Host is solely responsible for the accuracy of the bank details registered and must check, before requesting a withdrawal, that they remain current and accurate. Turs is not liable for delays, rejections, bank fees or losses arising from incorrect or incomplete details or from accounts held by someone else.

16.8. Withholdings. Turs may withhold as a precaution, in whole or in part, the amounts linked to a Booking where there are reasonable indications of fraud, open incidents, ongoing claims, requirements of a competent authority or breaches of these Terms, for the time strictly necessary to clarify the matter.

17. AI Assistant and automated communications

17.1. What it is and where it operates. Turs offers an automated assistant based on artificial intelligence (the AI Assistant, Section 2), available on: the website chat, the mobile application, each Tour's assistant, each Host profile's assistant, and the WhatsApp, Instagram and Facebook Messenger messaging channels. There is also a dedicated business assistant for Hosts. When you write on any of these surfaces, you are interacting with an automated system, with human oversight as described below. Use of the AI Assistant is optional: you can always reach a person through the support channels in Section 32 or ask within the conversation itself to be assisted by a human agent.

17.2. Third-party technology. The AI Assistant runs on artificial intelligence systems operated by specialized language-model providers acting on behalf of Turs, to which only the information strictly necessary to generate each response is sent. To generate responses, your messages, the recent conversation history and certain contextual information are processed through those providers. Voice notes you send via WhatsApp (speech-to-text transcription) and images you share in the chat are also processed through specialized providers acting on behalf of Turs. The details of this data processing, including the safeguards required of those providers, are described in the Privacy Policy.

17.3. What it can do. The AI Assistant can, among other things: recommend and search for Tours; answer questions about Bookings and policies; create Bookings and generate payment links; cancel your Bookings applying the Cancellation Policy (including the automatic refund where applicable); help you create an Account by verifying your email with a one-time code; record reviews for Bookings whose Tour already took place; open support tickets; and — for Hosts — manage Booking requests, schedule, spots, attendance and assisted Tour creation. All of these actions are executed within the limits and with the confirmations described in Section 17.4.

17.4. Limits and confirmations.

  • The AI Assistant never executes payments: every charge is authorized by you personally in the secure checkout process.
  • Sensitive actions (for example, cancelling a Booking) require your explicit confirmation in the conversation before being executed, and are in all cases governed by these Terms and by the Cancellation Policy. A cancellation confirmed to the AI Assistant has the same effects as one made in the application.
  • The AI Assistant can only operate on the data and Bookings of the person identified in the conversation; it cannot view or modify third parties' information.
  • The AI Assistant does not process refunds outside the Cancellation Policy: payment cases requiring an exception are referred to human review.

17.5. Possible errors. Artificial intelligence can generate inaccurate, incomplete or outdated responses. The binding information about a Tour, its price and its availability is the information shown on the Platform at the time of booking, and the applicable conditions are those of these Terms and the documents that form part of them. If a response from the AI Assistant contradicts these Terms or the published information of the Tour, the latter prevail. Turs takes reasonable measures to improve the quality of the responses, as an obligation of means. Please report any errors to our support team through the channels in Section 32.

17.6. Human oversight and escalation. Conversations with the AI Assistant may be reviewed by Turs staff. Our team can take control of a conversation at any time (in which case the AI pauses and a person assists you). In addition, the system automatically escalates certain cases to human attention (for example, complaints or requests to speak with an agent), and may route Tour-specific questions directly to the Host to answer.

17.7. Reminders and automated messages. The Platform sends automated communications related to your activity: Booking confirmations and notices by email, reminders 24 hours before the Tour through push notifications from the app and, if you agree to it in the conversation, through the messaging channel you used (WhatsApp, Instagram or Messenger), as well as operational notices to Hosts. You can manage push notifications from the app's preferences. On WhatsApp, when the conversation window is closed, reminders are sent using message templates approved by Meta.

17.8. Automatic translation. The chat between Travelers and Hosts offers automatic message translation powered by AI. Translations are provided as a courtesy and may contain inaccuracies; the original message prevails.

17.9. Acceptable use. It is not permitted to use the AI Assistant to attempt to obtain third parties' data, circumvent its security measures, manipulate it through malicious instructions, or generate unlawful or offensive content.

18. User Content and license

18.1. What it comprises. The Platform allows publishing or sending content: reviews and photographs of Tours, profile photos, Listing descriptions and photographs (Hosts), and messages in the Platform's chats.

18.2. Ownership and license. You retain ownership of your User Content. By publishing it, you grant Turs a non-exclusive, worldwide, royalty-free and sublicensable license to host, reproduce, adapt (for example, resize or translate) and display that content for the purpose of operating, promoting and improving the Platform, for as long as the content remains published and for the reasonable time necessary after its removal for compliance with legal obligations or the resolution of disputes. The license is limited to the stated purposes and does not transfer ownership of your content to Turs.

18.3. Rules. User Content may not: infringe third-party rights (intellectual property, privacy, image rights); be unlawful, defamatory, discriminatory, sexually explicit or violent; contain third parties' personal data without their consent; or include advertising or links intended to divert transactions off the Platform.

18.4. Representation of truthfulness. Whoever publishes content warrants that they hold the necessary rights over it (including photographs) and that the information it contains is truthful.

18.5. Moderation. Turs may review, moderate, refuse to publish or remove User Content that breaches these Terms or the law, without any obligation of prior notice, and may suspend the accounts responsible; the exercise of this power does not make Turs the author or editor of the content published by Users, nor does it imply a general obligation of supervision.

19. Intellectual and industrial property of the Platform

19.1. Ownership. The Platform — including its software, design, trademarks, logos, proprietary texts, databases and the editorial content generated or curated by Turs (such as the magazine) — is the property of Turs Technologies LLC or its licensors, and is protected by applicable intellectual property laws.

19.2. Limited license to the User. Turs grants you a limited, revocable, non-exclusive and non-transferable license to use the Platform in accordance with these Terms. You acquire no other right over the Platform or its content.

19.3. Reservation of rights. Copying, modifying, distributing, selling or commercially exploiting the Platform or its content without Turs's written authorization is not permitted, except for the normal use contemplated in these Terms. All rights not expressly granted are reserved to Turs. Use of Turs's trademarks and distinctive signs without prior written authorization is likewise prohibited. Any comment, suggestion or improvement proposal you submit voluntarily may be used freely by Turs, with no obligation of confidentiality, attribution or compensation.

19.4. User Content and Listings. User Content is governed by Section 18. Tour Listings belong to their Hosts, who grant Turs the license in Section 18.2 for their publication and promotion.

20. Notice and takedown of infringing content

20.1. Designated channel. If you believe that content published on the Platform infringes your copyright or any other right you hold, you may report it by writing to info@turslatam.com with the subject line "Infringement notice", or by opening a ticket through the help center inside the application.

20.2. Minimum content of the notice. For the notice to be processed, it must include: (a) a precise identification of the work or right allegedly infringed; (b) the exact location of the content within the Platform (for example, the link to the Listing or the review); (c) your contact details; (d) a good-faith statement that the identified use has not been authorized by the rights holder, their agent or the law; (e) a statement that the information provided is accurate and that you are the rights holder or are authorized to act on their behalf; and (f) your physical or electronic signature.

20.3. Takedown and counter-notice. Upon receiving a complete notice, Turs will evaluate it and, where appropriate, will expeditiously remove or disable access to the identified content, and may inform the User who published it, who may submit a counter-notice with equivalent information through the same channels.

20.4. Repeat infringers. Turs will suspend or terminate, in appropriate circumstances, the Accounts of those who repeatedly infringe third parties' rights.

20.5. Abusive notices. Filing manifestly unfounded or bad-faith notices may give rise to liability of the notifier for the damages caused.

21. Suspension, restriction and termination

21.1. Termination by the User. You may stop using the Platform at any time and request the deletion of your Account in accordance with Section 26. Outstanding obligations (active Bookings, penalties, payments) survive termination.

21.2. Measures available to Turs. Turs may warn, temporarily suspend or permanently terminate an Account, remove Listings and restrict access to the Platform when: (a) there is a breach of these Terms (including the prohibited conduct in Section 12); (b) required by law or by a competent authority; or (c) there is a risk of fraud or a security risk to other Users. Measures will be adopted in a reasoned manner and in proportion to the seriousness of the facts and, where reasonable, we will communicate the reason for the measure and how to appeal it through the support channels.

21.3. Effects. Suspension or termination does not affect rights already acquired or any refunds due under Section 13. If a Host Account is terminated, legitimate outstanding balances are settled in accordance with Section 16, after deducting any outstanding penalties or obligations.

21.4. Survival. The provisions relating to intellectual property, User Content, limitation of liability, indemnification, data protection, governing law and dispute resolution survive the termination of the relationship.

22. "As is" provision of the Service and disclaimer of warranties

22.1. Disclaimer. To the maximum extent permitted by applicable law, the Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including, by way of illustration, warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

22.2. Continuity. Turs does not guarantee that the Service will be uninterrupted or error-free, although it works reasonably to keep it available and secure. Turs may temporarily suspend access for maintenance, security or improvement reasons, endeavoring to minimize the impact and, where reasonably possible, giving advance notice.

22.3. Third parties. Turs is not liable for failures attributable to third parties (payment processors, messaging channels, infrastructure or artificial intelligence providers) or for force majeure events in accordance with Section 29. The availability and operation of those third-party services are governed by their own terms and are beyond Turs's reasonable control.

22.4. User content. Turs does not guarantee the accuracy, currency or lawfulness of the information published by Users, including Listings, without prejudice to the prior review described in Section 6.2.

22.5. Non-waivable rights. Nothing in this Section limits the rights that mandatory consumer protection rules grant to the User and that cannot be excluded by contract.

23. Limitation of liability, assumption of risk and insurance

23.1. Inherent risks of tourism activities. Tourism and outdoor activities (for example hiking, water activities, transportation, contact with nature) involve inherent risks, which may include injury. By booking and taking part in a Tour, the Traveler declares that they understand and voluntarily assume those inherent risks, assesses their own fitness for the activity and undertakes to follow the Host's safety instructions. This assumption of risk does not release the Host from their duty to provide the service with due diligence, nor does it cover damage caused by the Host's willful misconduct or negligence.

23.2. No insurance. Platform prices do not include travel, medical or accident insurance, and Turs does not provide any insurance coverage. Travelers are advised to purchase on their own any insurance they consider necessary, and Hosts are advised to hold the insurance required for their activity. Taking out such insurance is a decision of the Traveler and the Host themselves, unrelated to Turs, which is not involved in its selection, contracting or management.

23.3. Exclusions. In its capacity as a technology intermediary, and to the maximum extent permitted by applicable law, Turs assumes no liability for the following:

  • The performance, quality, safety, legality or suitability of the Tours, which are the responsibility of the Host who provides them.
  • The acts or omissions of Hosts, Travelers or third parties, as well as damage caused by one User to another or to third parties.
  • Accidents, injuries, personal or property damage, theft or losses occurring during a Tour or in connection with it, without prejudice to any liability of the Host.
  • Personal belongings forgotten, lost or stolen during a Tour.
  • The cancellation or modification of a Tour by the Host, beyond the refunds and penalties provided for in Section 13.
  • Errors, inaccuracies or omissions contained in responses generated by artificial intelligence systems, as set out in Section 17.5.
  • Interruptions, unavailability or failures arising from causes beyond Turs's reasonable control, including those attributable to payment processors, messaging channels and infrastructure or artificial intelligence providers.
  • Loss of profit, loss of opportunity, loss of data, reputational damage and, in general, indirect, incidental, special, punitive or consequential damages of any kind.
  • Amounts paid or received outside the Platform, which carry no coverage, assistance, mediation or protection whatsoever, in accordance with Section 8.6.

23.4. Liability cap. To the maximum extent permitted by applicable law, Turs's total liability toward a User for claims arising from the use of the Platform is limited to the amount of the service fees Turs has received from that User in the 12 months preceding the event giving rise to the claim, or the amount actually paid for the Booking that is the subject of the claim, whichever is greater.

23.5. Non-waivable rights. Nothing in these Terms limits liability that cannot legally be excluded (including willful misconduct or gross negligence) or the non-waivable rights that the Consumer Protection Law and other mandatory rules of the Republic of El Salvador grant to consumers.

24. Indemnification

You agree to indemnify and hold harmless Turs, its affiliates and its personnel from third-party claims, damages, penalties and reasonable expenses (including legal fees) arising from: (a) your breach of these Terms or of the law; (b) your User Content; (c) in the case of Hosts, the provision of their Tours and the breach of their legal, tax or safety obligations. This obligation does not apply to the extent the damage is attributable to Turs, and does not limit any non-waivable rights you may have as a consumer.

25. Personal data protection

The processing of your personal data — including Account and Booking data, conversations with the AI Assistant, data shared with the categories of recipients described in that policy (among them, payment service providers, providers of artificial intelligence systems acting on behalf of Turs, and Meta Platforms as operator of the messaging channels) and your rights over your data — is described in the Privacy Policy, published at turslatam.com/privacy, which forms part of these Terms and which details the categories of data processed, the purposes, the categories of recipients, the retention periods, automated decisions and the channels for exercising your rights. We recommend reading it before using the Platform. By accepting these Terms you declare that you have been informed of its content.

26. Account deletion

26.1. Procedure. You can request the deletion of your Account by writing to info@turslatam.com from the email address associated with your Account.

26.2. Prerequisites. We may postpone or refuse the deletion while there are: (a) active bookings, or bookings pending settlement, associated with your Account, which must first be completed or cancelled in accordance with the Cancellation Policy; (b) open support cases; or (c) in the case of Hosts, balances pending withdrawal or penalty appeals in progress.

26.3. Effects and retention. Deletion of personal data is carried out in accordance with the Privacy Policy. We may retain certain information where necessary to comply with legal, accounting or tax obligations, resolve disputes or enforce these Terms (for example, transaction records).

27. Communications, notices and electronic contracting

27.1. Means. You agree that communications and notices relating to the Platform, your Bookings and these Terms may be sent to you by electronic means: the email address associated with your Account, push notifications and in-app notices and, where you have used that channel, the messaging channels (WhatsApp, Instagram or Facebook Messenger). On WhatsApp, when the conversation window is closed, certain messages are sent using templates approved by Meta, in accordance with Section 17.7.

27.2. Validity of electronic contracting. You acknowledge that electronic communications satisfy any legal requirement of written form, and that the acceptance of these Terms and the contracting of Bookings carried out by electronic means are fully valid and have full evidentiary effect.

27.3. Duty to keep details current. It is your responsibility to keep your contact details up to date and operational and to review the communications you receive. Notices sent to the details on record in your Account shall be deemed validly served.

27.4. Language. Communications may be made in Spanish or in English. In case of discrepancy between versions, the Spanish version prevails, in accordance with Section 1.5.

28. Changes to the Terms and to the economic conditions

28.1. Right to modify. Turs may modify these Terms and the economic conditions of the Service (including the Traveler service fee, the Host commission, the minimum withdrawal amount and the referral program values), in order to adapt them to regulatory, technical, operational or market changes. We will publish the updated version on the Platform with its last-updated date and, when the change is substantial (for example, changes to fees, the Cancellation Policy or Users' rights), we will communicate it with reasonable advance notice through the Platform or by email.

28.2. Bookings already paid. Changes do not affect Bookings already paid before they take effect: those Bookings remain governed by the Terms and percentages in force at the time of payment.

28.3. Acceptance. If you continue using the Platform after a modification takes effect, you will be deemed to have accepted it. If you do not agree, you must stop using the Platform and may request the deletion of your Account.

29. Force majeure

Neither party shall be liable for the non-performance or late performance of its obligations where this is due to force majeure or unforeseeable events, understood to include, by way of illustration, extraordinary natural phenomena, earthquakes, eruptions, floods, fires, epidemics and pandemics, acts of authority, armed conflicts, civil unrest, prolonged power or telecommunications outages, large-scale cyberattacks and widespread failures of essential providers. The affected party must give notice without undue delay and take reasonable measures to mitigate the effects. Any refunds due in these cases are governed by the Cancellation Policy.

30. General provisions

30.1. Entire agreement. These Terms, together with the Cancellation Policy, the Privacy Policy and the particular conditions of each Booking, constitute the entire agreement between the parties with respect to their subject matter.

30.2. Severability. If any provision of these Terms is declared invalid, the remaining provisions will remain in full force, and the invalid provision will be interpreted or replaced in the way that best reflects its purpose to the extent permitted by law.

30.3. No waiver. Turs's failure to exercise, or delay in exercising, any right provided for in these Terms does not constitute a waiver of that right or prevent its later exercise.

30.4. Assignment. You may not assign your contractual position or the rights and obligations arising from these Terms without Turs's prior written authorization. Turs may assign its contractual position in cases of corporate reorganization, merger or business transfer, informing Users accordingly.

30.5. Single version. A single version of these Terms applies to all Users of the Platform, with no country-specific versions, without prejudice to the mandatory rights to which the User is entitled under the regulations of their place of habitual residence.

30.6. Survival. Provisions which by their nature should remain in force after the termination of the relationship shall retain full effect, in accordance with Section 21.4.

31. Governing law, amicable resolution and dispute resolution

31.1. Prior amicable resolution. Before initiating any action, we ask that you contact our team through the channels in Section 32 to attempt in good faith a direct resolution of the dispute. Most cases are resolved this way, and the parties undertake to cooperate loyally during that resolution attempt.

31.2. Governing law. These Terms are governed by the laws of the State of Delaware, United States, the operator's place of formation.

31.3. Non-waivable consumer rights. Nothing in these Terms limits, excludes or replaces the non-waivable rights you may have as a consumer under the laws of your country of habitual residence. In particular, if you reside in El Salvador, you fully retain the rights granted to you by the Consumer Protection Law (Ley de Protección al Consumidor) and you may turn to the Consumer Protection Office (Defensoría del Consumidor).

31.4. Consumer relationship for the Tour. The consumer relationship for the Tour itself is directly between the Traveler and the Host and is performed in the country where the Tour is provided (currently, El Salvador).
